Thank you for choosing to join us. We know that reading long T's&C's is boring so we've tried to keep this short. Please do read this through as it contains important information.
“We / The Organiser” = Make+Move
“The client” = event attendee
“The event” = class, retreat, workshop, course, programme
Terms of service
MAKE+MOVE lists what is included on each event page. Travel to the venue, insurance, personal kit is rarely included. If you are unsure of inclusions, please contact hello@makeandmove.me
BOOKING POLICY:
All bookings are made via www.makeandmove.me or direct with Lucy Wright.
By making a booking you are agreeing with these Terms and are bound by them; your personal data will be used in accordance with the Privacy Policy and you accept full financial responsibility for payment of the booking for yourself and any others that you book.
Payment is required at the time of booking. This may be full payment or a deposit and at this point your event is considered confirmed; you are strongly advised to ensure that you have insurance to cover cancellation or curtailment.
When booking via www.makeandmove.me and its’ booking system www.arketa.co you are able to amend/cancel as you wish when outside of the cancellation period. Please notify hello@makeandmove.me should you wish to cancel/discuss your booking within the cancellation period.
GROUP SIZE:
These events are intimate in size and have a minimum group size required for them to go ahead. If this exists, this number is clearly stated on the booking page. Should the minimum number not be met, the Organiser will contact all bookings and offer a refund or alternative.
COVID 19 clause:
Please follow current Government guidance relating to COVID19. If you are displaying symptoms of COVID19 you should not travel to retreat or a class.
Due to the intimate nature of these events, it is unlikely that a refund will be possible in the event of a client testing positive – or having to self-isolate – for COVID19 and therefore not attending.
In the event of the Organiser having to cancel an event due to COVID19, an alternative event will be offered to clients and a refund will also be possible.
CANCELLATION POLICY:
Retreats
You (or any member of your party) may cancel your booking at any time, provided that the cancellation is made by the person submitting the booking confirmation and is notified in writing. Cancellation will take effect the day such notification is received by us.
Deposits are non-refundable and non-transferable.
For cancellation requests submitted more than 90 days in advance of the retreat, 50% of your balance will be refunded. For cancellation requests made within 90 days of the retreat, no refunds will be given. If another person can be found to take your place, then we may offer you a refund at our discretion. No refunds or credits will be granted for failure to attend, complete or for arriving late or leaving early.
In the unlikely event of the Organiser needing to cancel we will give as much notice as possible and refund all payments.
Please note that we cannot accept responsibility for any other/3rd party costs you may have incurred in relation to the original booking.
Classes
Please cancel your attendance through this website.
All classes have a 24hour cancellation policy. Should you cancel more than 24 hours in advance, you will be able to rebook.
If you have bought a pack / block of classes, these are to be used within 60 days (5 class pack) or 90 days (10 class pack).
Programmes and courses fall within this same cancellation policy. Inability or failure to attend a session will not result in a refund.
Health:
MAKE+MOVE are not medical professionals, nor will there be such a person present in classes or retreats. Please speak with a medical professional prior to booking should you wish to discuss suitability on these grounds.
It is your responsibility to let us know if you have any injuries and to be mindful at all times of your own body’s capability during sessions. If you experience any injury or pain during any activity, then you must desist immediately.
Please advise of any mental or physical health conditions and dietary requirements before you book. If you have health conditions and dietary requirements that may be affected by the activities offered we reserve the right to advise you to desist and in the interests of your wellbeing, or others, we may decline your participation.
ACKNOWLEDGEMENT:
Although MAKE+MOVE has taken reasonable steps to ensure safety, participants must acknowledge that activities have risks, including certain risks which cannot be eliminated without destroying their unique character. The same elements that contribute to the unique character of this activity can cause loss or damage to the Participant including accidental injury, illness or in extreme cases, permanent trauma, disability or death and can cause damage to or loss of property. The following describes some, but not all, of those risks.
Activities vary between retreats and may include but are not limited to: yoga; forest bathing; natural movement; breathwork; meditation; walking; running; hiking; paddle-boarding / stand-up paddle-boarding; kayaking and canoeing; swimming, snorkeling, surfing; swimming.
Throughout the retreat, participants are responsible for their own safety.
Should you choose to book additional excursions whilst on retreat, these will fall outside of this agreement. MAKE+MOVE is not responsible for the provision of excursions and your agreement will be with the provider.
For overseas events, it is your responsibility to check and fulfil the passport, visa, health, insurance and immigration requirements applicable to you and your itinerary.
LIABILITY:
We accept responsibility for ensuring that the events are supplied as described and that the services we are contractually obliged to provide are to a reasonable standard.
We do not accept responsibility for any loss of, or damage to personal property of attendees.
We do not accept any liability for cancellations, delays or changes caused by war, threat of war, terrorist actions or threats, closure of airports, civil strife, industrial action, natural disaster, technical problems to transport, staff cancellations, unforeseen changes in your personal circumstances or other events beyond our control.
The participant will be responsible for any damage caused to the property of the Organisers, associated contractors and the accommodation used for the Retreat.
The attendee will agree to make good or pay full restitution for the making good of any such damage.
Personal injury or any kind of liability which may arise from the participation in an activity during the event will not be the responsibility of the Organisers. We are not liable for any injuries you may incur. sessions are undertaken at your own risk.
We hold no responsibility for delayed, missed, or cancelled transportation (e.g., flights, buses, transfers) required by the client to reach the event or any activity relating to the event.
WAIVER:
DECLARATION OF HEALTH. By accepting these Terms & Conditions participants represent that they have no physical conditions or medical precautions which would adversely affect their abilities to take part in a MAKE+MOVE class or event. Attendees fully understand their participation could be injurious to their health and voluntarily assume all risks related to such activities.
PERSONAL RELEASE. By agreeing to the terms outlined here and elsewhere on the MAKE+MOVE website participants hereby release and discharge their rights and claims for damages or liabilities that may occur as a result of participation on a MAKE+MOVE class or event, including but not limited to damages as a result of unexpected occurrences including those from weather, wildlife or uncontrollable acts of God, including the risk of death. I release MAKE+MOVE including its owners, directors, employees, guides, teachers and partners from liability for personal injury, illness, emotional damage, incurred travel expenses or property damage I may incur because of participation on this retreat.
For the benefit of everyone at a class or event, MAKE+MOVE reserves the right to accept or reject any participant at any time without liability and in the event it determines, in its sole and exclusive discretion, that a participant is disruptive to the harmony of the class or event, it may without any obligation to pay a refund or any other amount whatsoever, expel such participant. MAKE+MOVE will carry no responsibility or liability for any participant who leaves under such circumstances.
Copyright, trademarks and intellectual property:
All material on this website and all written materials shared during classes or events are owned by or licensed to MAKE+MOVE and may not be copied or reproduced without written permission.
Data Protection:
MAKE+MOVE will not share your personal data with any third parties for any reasons without your prior consent. Such data will only be collected, processed and held in accordance with the provisions and principles of the Data Protection Act 2018.
Law and Jurisdiction:
These Terms and Conditions (including any non-contractual matters and obligations arising therefrom or associated therewith) shall be governed by, and construed in accordance with, the laws of England and Wales.
Any dispute, controversy, proceedings or claim between the Parties relating to these Terms and Conditions (including any non-contractual matters and obligations arising therefrom or associated therewith) shall fall within the jurisdiction of the courts of England and Wales.
